Withdrawn: This Legal Update Reported Reforms That Did Not Happen

This article has been withdrawn. It was published on 14 June 2026 as a legal update for buyers, and it reported changes to Spanish law that we cannot trace to any published source. We are leaving this URL in place, with the correction, rather than deleting it — anyone who read or cited the original is entitled to find the retraction where the article used to be.

What the original claimed

Why it was withdrawn

Ley 38/1999, de Ordenación de la Edificación, was not amended in 2026; our retractions of the articles of 21 May and 29 May 2026 already say so. It is a building-standards law. It does not classify land, and we cannot trace the certificate, the reclassification or the registry rule described here to the Boletín Oficial del Estado. The costs, delays and hectares attached to them had no source, and neither did the statements about named developments. The data-protection authority keeps no register of beneficial owners.

The sentence on the Beckham Law was the opposite of the rule. The regime of Article 93 LIRPF is not an exemption: it taxes the Spanish-source employment income of people who relocate to Spain on a qualifying route at a flat rate for a limited number of years, and gains on Spanish property stay taxable in Spain.

The article was produced by an automated pipeline that was asked for an update on recent changes in the law while having no access to the Boletín Oficial del Estado. Given no reform to report, it composed one. The brief for this beat has since been changed: it is explanatory only, and it may not report an amendment or cite a legal instrument outside a verified list.

What can be relied on

For purchase taxes and the terms of the Beckham Law, see our guide to property taxes in Marbella and Spain. Spain's Golden Visa was abolished with effect from 3 April 2025; the residency routes that remain are set out in our Spanish Golden Visa 2026 update. For the planning status of a specific plot or property, ask a Spanish lawyer and the town hall's planning office; nothing on this page is legal or tax advice.
