Where buyers commonly trip up

Treating staff as autonomos (self-employed) when they are not. A housekeeper working set hours at one villa under your supervision is an employee under Spanish law, regardless of what the contract says. Filing them as autonomo to avoid social security is the single most common Marbella tax error and triggers automatic Inspección de Trabajo review on any complaint.

Cash payment. Spanish anti-money-laundering law caps domestic cash payments at €1,000 per transaction (€10,000 for non-residents). Paying a €2,000 monthly housekeeper salary in cash is illegal and triggers automatic Hacienda flagging if the housekeeper deposits the cash.

No written contract. Verbal agreements are legally valid but practically catastrophic. The Modelo TA.0202 short-form contract takes 30 minutes to file via gestoría and costs €40–80. Skipping it exposes the employer to indefinite-contract presumption on dispute.

Underestimating the 14-pay structure. Spanish salaries are quoted monthly but paid 14 times per year (regular months + July and December "pagas extras"). A "€2,000/month" housekeeper costs €28,000 per year in salary alone, not €24,000.

Holiday and replacement cover. Live-in staff get 30 calendar days paid holiday. You either close the villa for that month or hire a replacement at premium rates (€150–250/day). Budget 8% on top of base salary for replacement cover during holidays and sick leave.
